Warranties

Warranty applicable to reconditioned spas

AquaMagic grants a limited warranty on reconditioned spas. The warranty period is of one (1) year and begins on the actual delivery date. None of the warranties granted by AquaMagic can be assigned.

Application

  • For the warranty to apply, the hot tub must have been connected by a certified master electrician.
  • The limited warranty covers parts and labor, with exceptions and exclusions.
  • The PURCHASER who wishes to obtain the execution of the warranty must file a request to AquaMagic and describe the problem observed.
  • The choice of means to apply the warranty is up to AquaMagic. It has the obligation to repair or replace the goods which are defective, if they are covered by the warranty period.
  • If the parties agree to a payment, AquaMagic will make a payment equal to the cost of the part or the cost of repairs to the part, whichever is less.
  • Unless an exception is allowed by AquaMagic, repairs must be made by a representative of AquaMagic for the warranty to be applicable.
  • When a service call is requested by the PURCHASER for a repair, the latter has the obligation to provide reasonable access to the spa, regardless of the season.

Commercial use

Notwithstanding any other provision, any good purchased for commercial use, whether this information is disclosed or not at the time of purchase, will have a basic limited warranty of three (3) months.

Exclusions

No warranty is applicable for damage which is attributable to misuse, improper maintenance, improperly balanced water or negligence of the PURCHASER.

No warranty is applicable to damage caused by frost since it is the PURCHASER’s responsibility to ensure that the spa is operating normally.

Damage

If it is necessary to drain the water in order to make warranty repairs, AquaMagic is not responsible for the cost of refilling the spa and for adding chemicals.

Particularity of reconditioned spas

 The acrylic spa shell is not covered by any warranty  from AquaMagic against manufacturing defects. AquaMagic however undertakes to give a guarantee of good condition at the time of delivery, except for defects already existing at the time of purchase.

The facilities included in the following list are not covered by any warranty:

  • Original sanitation system installed by the manufacturer
  • Complete audio system (including transformers if applicable).
  • Light system.
  • Jets and headrests

Warranty applicable to new spas

For the warranty to apply, the hot tub must have been connected by a certified master electrician.

The BUYER benefits from the warranty offered by the manufacturer. However, this warranty does not bind AquaMagic. The PURCHASER will have to communicate with the manufacturer for the application of such warranty.
